Please read these Terms and Conditions carefully before accessing or using the Market Whale platform.

1. Acceptance of Terms

By accessing or using Market Whale (“the Platform”), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you must not use the Platform.

2. Description of the Service

Market Whale provides a non-custodial interface and tooling layer for interacting with decentralized liquidity protocols on the Solana blockchain. The Platform enables users to:

• Interact with decentralized automated market makers (AMMs), including Pump AMM.
• Trade and manage positions on Raydium Launchpad and Raydium liquidity pools.
• Execute trades across multiple self-custodied wallets using a single authorization flow.
• Monitor balances, transactions, and performance metrics such as profit and loss (PnL).

Market Whale does not custody user funds, control user wallets, execute transactions without user authorization, or operate as a broker, exchange, or financial intermediary.

3. Eligibility

You must be at least 18 years old and legally permitted to use blockchain-based services in your jurisdiction. By using the Platform, you represent that you meet these requirements.

4. Wallet Connectivity & User Responsibility

Access to the Platform requires connecting a compatible blockchain wallet. By doing so, you acknowledge and agree that:

• Market Whale only processes public wallet addresses for authentication and functionality.
• Private keys, seed phrases, and signing credentials remain entirely under your control.
• All transactions are initiated and approved by you through your wallet provider.
• You are solely responsible for all activity associated with your wallet.

5. Third-Party Protocols

The Platform integrates with third-party decentralized protocols, including but not limited to Pump AMM and Raydium. Market Whale does not own, operate, or control these protocols and makes no representations regarding their functionality, security, or availability.

Any interaction with third-party protocols is subject to their respective terms and conditions.

6. Risks Disclosure

Digital assets and decentralized markets involve inherent risks, including but not limited to price volatility, smart contract vulnerabilities, network congestion, and partial or total loss of funds. Market Whale does not guarantee outcomes or performance of any transaction.

You acknowledge that you use the Platform at your own risk and are responsible for assessing whether any interaction is appropriate for your circumstances.

7. No Financial or Investment Advice

Market Whale provides technical tools and data visualization only. Nothing on the Platform constitutes financial, investment, legal, or tax advice. You are solely responsible for your decisions and actions.

8. Acceptable Use

You agree to use the Platform in compliance with applicable laws and regulations. You must not:

• Use the Platform for unlawful or deceptive activities.
• Attempt to disrupt or compromise the security or integrity of the Platform.
• Misuse the Platform in a manner that could reasonably cause harm to other users or the ecosystem.

9. Fees

Certain features of the Platform may involve fees. Any applicable fees will be disclosed prior to use. You are responsible for all blockchain network fees incurred through your transactions.

10. Intellectual Property

All software, interfaces, text, and visual elements provided by Market Whale are protected intellectual property. You are granted a limited, non-exclusive, revocable license to use the Platform in accordance with these Terms.

11. Limitation of Liability

To the maximum extent permitted by law, Market Whale shall not be liable for any indirect, incidental, or consequential damages arising from use of the Platform, including loss of funds, profits, or data.

12. Indemnification

You agree to indemnify and hold harmless Market Whale from any claims or liabilities arising from your use of the Platform or violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the applicable jurisdiction in which Market Whale operates, without regard to conflict of law principles.

14. Changes to These Terms

Market Whale may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the revised Terms.
